NEWS DESK - A court has refuse to grant bail to a man accused for raping model ,observing that the allegations against him are serious and required though investigation before any relief can be considered .According to the prosecution,the accused allegedly exploited the victim by promising professional opportunities and later sexually assaulted her . The woman approached the police and filed a complaint , following which a case was registered and an investigation was launched .
The accused , identified as Akshaykumar Kantilal Jain who hails from surat ,was arrested on April 25 by the kashimira Police in Thane under sections 64 and 351 of the Bharatiya Nyay Sanhita ,the Prosecution said .The 26 year old complaint ,a professional model originally from Punjab , alleged that Jain lured her from Goa to a Hotal in Mira Road on the pretext of an acting audition ,spiked her tea , and forcibly established sexual relations .During the proceedings , the defence sought bail on the ground that the complaint had submitted a notarised affidavit -cum-declearation stating she wished in withdraw her allegations because her marriage had been fixed.
Additional public prosecutor Manisha Pawse argued that the accused did not deserve bail at this stage .while rejecting the bail plea , judge ghule observed , The reason given to fare of spoiling of marriage ,which is irrelvant.the offence against society at large.citing the survivors affidavit to the court ." she fear if the bedroom comes to know about the incident it will affect her married life .The offence is not compoundable ,the judge said nothing that the investigetion is still complete and the charge sheet is yet to be filled.
a non-compoundable offence is serious crime where the parties involved cannot legally settle or compromise out side of the court.
