The Supreme Court has raised concerns over delays by Governors and the President in granting assent to bills passed by state legislatures. The bench questioned whether such prolonged inaction could amount to contempt of court, given earlier directives requiring timely decisions.
The matter came up during a hearing on petitions filed by various states, which argued that constitutional authorities are expected to act within a reasonable timeframe. Lawyers representing the states said that indefinite delays undermine the democratic process and obstruct the functioning of elected governments.
The Court observed that withholding assent without clear reasons creates uncertainty and could stall important legislation. It emphasised that the constitutional scheme requires cooperation between the legislature and executive, with checks and balances maintained in good faith.
While the issue of contempt was raised, the judges noted that a broader interpretation of constitutional provisions may be required to decide the extent of accountability of Governors and the President in such cases. The hearing will continue as the Court seeks clarity on the balance of powers under the Constitution.
