Patel posted on X at 6:21 pm ET that a "subject" in Kirk's murder was in custody, only to retract this at 7:59 pm ET, announcing the individual's release after interrogation. Given that Rao's begins seating at 7 pm, the timeline of his updates from the restaurant has "raised eyebrows".

Former FBI officials have strongly criticized Patel's actions, with one leader accusing him of a "public inability to meet the moment as a leader" and highlighting his "inexperience".
