The Supreme Court is poised to deliver its interim order on September 15 regarding the suspension of the Waqf (Amendment) Act, 2025. This follows nearly four months after a bench, led by Chief Justice of India (CJI) Bhushan R Gavai and Justice AG Masih, reserved its ruling on 21 petitions challenging the law’s validity.
The court had earlier refused to stay a government notification requiring all waqf properties to be registered on the UMEED digital portal within six months, citing that judgment was already reserved.
Petitioners argue the Act discriminates against Muslims, undermining their constitutional right under Article 26 to administer property, and shifts the onus of registration unfairly onto the community. They also question provisions like eligibility criteria for dedicating waqf and the potential loss of properties recognised through usage.
The Centre defends the law as a necessary reform for transparency and curbing misuse, asserting waqf is a "secular concept" not essential to Islam. The interim ruling will specifically address the power to denotify properties, the composition of waqf boards, and inquiries into government land claims. The decision is expected to have significant implications for waqf management nationwide.
