Bombay — The Bombay High Court has clarified that merely possessing documents such as an Aadhaar card, PAN card, or voter ID does not automatically confer Indian citizenship. The observation was made by a division bench while hearing a case related to an individual accused of being an illegal immigrant.
The court emphasised that these identity documents are issued for various administrative purposes but are not conclusive proof of citizenship. “These documents may serve as identity proof, but they cannot be relied upon to establish nationality,” the bench noted.
The ruling came during a plea challenging proceedings initiated against the petitioner by authorities under immigration laws. The petitioner had argued that since he possessed Aadhaar, PAN, and voter ID, he should be considered an Indian citizen. The court rejected this argument, stating that citizenship is determined under the provisions of the Citizenship Act, 1955, and not merely by the possession of such documents.
The bench further pointed out that enrolment for Aadhaar or issuance of PAN is not contingent on verifying citizenship status, but rather on fulfilling criteria such as residency or income-related requirements. Similarly, errors or gaps in the voter registration process cannot override statutory citizenship provisions.
Legal experts have noted that the judgment reinforces the distinction between identity and nationality, stressing the importance of documentary evidence such as birth certificates, citizenship certificates, or valid naturalisation records for proving citizenship status.
