Shivani Jaiswal , Uttar Pradesh - The Allahabad High Court has said that a person cannot be branded as a “goonda” just because of one or two criminal cases registered against them.
The court made this observation while hearing matters related to the use of strict preventive laws, including the Uttar Pradesh Goondas Act. These laws allow authorities to take action against people who are considered habitual offenders or a threat to public safety.
The court clarified that having a small number of criminal cases does not automatically prove that a person is a repeat offender or involved in ongoing criminal activities. There must be clear and strong evidence showing a pattern of repeated wrongdoing before such a serious label is used.
It also warned that using these laws without proper care can harm a person’s reputation and personal liberty. The judges emphasized that legal powers must be used carefully and not in an unfair or mechanical way.
According to the court, every case must be checked properly, and authorities should ensure that there is real material showing consistent criminal behavior before declaring someone a goonda.
Legal experts say this decision strengthens the idea that every person is presumed innocent until proven guilty in court. It also highlights the need to protect individuals from misuse of preventive laws.
The ruling is expected to guide police and administration in Uttar Pradesh to apply such laws more carefully in the future.
