Desk Correspondent , New Delhi - The Delhi High court has formally dismissed an election petition filed by BJP leader Yogender Chandolia against former Karol Bagh MLA Vishesh Ravi, citing significant legal and procedural deficiencies. The Division Bench, compromising Justice Dinesh Mehta and Justice Vinod Kumar, ruled on Saturday that the petition had became infructuous following the conclusion of the 2025 Delhi Assembly elections. The court emphasised that the mandate of the masses cannot be easily distributed unless the legal challenges brought forward adhere strictly to the precise statutory provision of election law.
The core of the dispute involved allegations that Vinesh Ravi had provided false disclosures regarding his educational qualifications. However, the court found that Chandolia's legal team had incorrectly invoked Section 123(4) of the Representation of the People Act. This specific provision pertains to false statements made about other candidates to damage their prospects, rather than a candidate making incorrect claims about themselves. While the Bench acknowledged that such allegations might potentially fall under "undue influence" under Section 123(2), it noted that this ground was not properly pleaded in the original petition, preventing the court from expanding its inquiry beyond the cited legal framework.
Relying on Supreme Court precedents, the High Court clarified that supplementary disclosures like educational qualifications rarely suffice to invalidate an election unless they carry a substantial, proven impact on the result. The judges reiterated that election law requires rigorous and precise pleadings, which were absent in this case. Given that the term of the contested Assembly had already expired and a fresh electoral cycle was completed in 2025, the court concluded that the matter no longer held any practical relevance, thereby ending the protracted legal battle between the two political figures.
