Singh , New Delhi - The Delhi High Court on Thursday reserved its verdict on an interim plea by MP Raghav Chadha, who is seeking the immediate takedown of social media posts alleging he "sold himself for money" after switching from AAP to the BJP. Chadha’s lawsuit contends that unauthorized, AI-generated "deepfake" content is being maliciously circulated to inflict grave damage on his reputation and legal rights. His legal team, led by Senior Advocate Rajiv Nayar, argued that posts implying a financial trade for a political move cross the boundary of fair comment and should be stripped from platforms without delay.
The legal arguments focused heavily on balancing personal dignity against constitutional liberties. Justice Subramonium Prasad noted that the line between defamation and criticism is incredibly thin, warning that it is easy to slip into infringement on either side. Drawing a direct parallel to India's robust history of political satire, the court highlighted how public figures have long faced sharp commentary, from historic newspaper cartoons to modern social media channels. Because the offending posts were uploaded by anonymous internet users, the judge also suggested appointing an amicus curiae—an independent legal expert—to help navigate the complex digital dispute.
The court ultimately signaled a high threshold for censoring public political discourse at this preliminary stage. Refusing to grant an immediate, unexamined sweeping injunction against the content, Justice Prasad orally remarked, "According to me, prima facie, these are all only criticism of a political decision."
