Bombay High Court rules to put Goa FAR approvals on hold

Desk Correspondent , Panaji — The Bombay High Court at Goa has issued a critical directive stating that all approvals for higher Floor Area Ratio (FAR) and building height relaxations granted by the Town and Country Planning (TCP) department are subject to the outcome of ongoing Public Interest Litigations (PILs). This ruling, delivered by Justices Bharti Dangre and Ashish S. Chavan, mandates that future TCP approvals must include a explicit clause declaring them provisional until the final verdict, preventing irreversible construction amid legal uncertainty. Over 739 such approvals have already been issued since 2023, with 255 more pending, affecting projects statewide including those by entities like Golden Globe Hotels Pvt Ltd. and Prakash Gurudas Timblo. The decision came during hearings around April 15-17, 2026, with the PILs' final arguments now set for June 15, 2026.

At the heart of the controversy are 2022 and 2023 amendments to the Goa (Regulation of Land Development and Building Construction) Act, 2008, and the Building Regulations 2010. These changes permit unrestricted FAR increases up to 200% and heights up to 24 meters in zones previously capped at FAR 60 and 9 meters, primarily in low-intensity and settlement areas. Petitioners, led by the Goa Foundation and citizens from Margao and Panaji, argue these relaxations blatantly violate zoning laws, erode Goa's settlement character, and favor private developers over environmental and urban planning safeguards. The High Court has effectively frozen implementation to avoid a scenario where hundreds of permissions could be nullified post-ruling, spotlighting broader concerns over unchecked real estate growth in the coastal state.

This intervention underscores escalating tensions between development pressures and regulatory integrity in Goa, where rapid construction has long threatened ecological balance and local lifestyles. By conditioning approvals, the court ensures judicial oversight trumps administrative haste, potentially reshaping the state's building landscape if the PILs succeed. Stakeholders, including the Goa government and TCP officials, face heightened scrutiny, as the June hearing looms. The ruling not only halts potential overbuilding but also signals a pushback against amendments seen as loopholes for commercial exploitation, urging a reevaluation of sustainable urban policies amid Goa's tourism-driven economy.
